State disputes Tanzanian businessman’s claims

ATTORNEY General Likando Kalaluka has challenged a Tanzanian businessman to prove his alleged unlawful imprisonment in the Lusaka High Court after he sued the State claiming that he was unlawfully detained on charges of conspiracy to commit a felony with other prisoners.
Earlier, Jaffary Abdul sued the State and alleged that on July 31 2017 while leaving the Lusaka Correctional Prison, he was arrested and detained at Ridgeway police post without being informed of the reason for his detention.
Mr Abdul claimed that he was later charged with conspiracy to commit a felony three weeks after his arrest and that he was tortured without justifiable cause.
He also claimed that as a result of his unjustified charge and unlawful incarceration, his dignity was injured and his outlook on society as a reformed person lowered.
Mr Abdul was demanding K50, 000 damages as cost for legal representation, exemplary damages for false imprisonment and emotional distress.
But in his defence, Mr Kalaluka denied allegations that Mr Abdul’s arrest was unlawful.
Mr Kalaluka challenged Mr Abdul to prove at trial that he was tortured and interrogated by the police.
He indicated that Mr Abdul’s alleged arrest was investigated following claims that he was conspiring to commit a crime.
“I will avail at trial that Mr Abdul’s arrest was investigated as a result of allegations that he was conspiring with other prisoners to commit serious offences against the security of the nation,” he said.
Mr Kalaluka denied claims that Mr Abdul had suffered any losses or that he should be paid the K50, 000 or any exemplary damages and will be put to strict proof at trial.
