Ex ZSIC boss sues tenant for US$4, 500
By CHINTU MALAMBO FORMER Zambia State Insurance Corporation (ZSIC) managing director Irene Muyenga has sued her tenant in the Lusaka High Court demanding payment of $4, 500 with interest at current bank rates in outstanding rental arrears.
Ms Muyenga alleged in a statement of claim filed in the Lusaka High Court that Shadreck Kasanda Kapesa, a business executive, was her tenant occupying her property in the Mass Media area of Lusaka and that he has neglected to settle his rental arrears as per lease agreement.
She claimed that she had been deprived of income and had suffered loss and great inconvenience as a result of her tenant’s refusal to settle his dues.
Ms Muyenga indicated that she and Mr Kapesa entered into an oral lease agreement in September 2016 where it was agreed that he would be paying $1, 500 three months advance for renting he property.
She indicated that between September 2016 and September 2017 Mr Kapesa had been up to date with his rental payments as per terms of the lease agreement but had defaulted on his rent payments from August 2017 and was in arrears of K20, 000.
“Mr Kapesa defaulted on his rental payments in the third quarter of the 2017 and has neglected to pay the rental amount due for the fourth quarter of 2017and he is in arrears for the 3rd quarter of 2017 in the amount of K20, 000 being outstanding balance,” Ms Muyenga said.
Ms Muyenga claimed that she served Mr Kapesa a notice to vacate her premises due to the breach of the lease agreement on August 31 2017 but he had not vacated despite the notice period which expired on December 1, 2017.
She also claimed that her latest letter of demand written to Mr Kapesa through her advocates had been ignored despite acknowledgement of receipt.
Ms Muyenga was now demanding rental arrears of $4, 500 and K20, 000 including interest on both amounts.
She also seeks damages for breach of lease agreement and loss of income and an order to vacate her property, cost and any other relief that the court may deem fit.
