Rhema Life Church sues 2 Lusaka women

RHEMA Life Church in Lusaka’s Nyumba Yanga has asked the High Court to declare that the lease agreement executed between it and two Lusaka women cannot be terminated without compliance of terms of agreement after the two women allegedly evicted members of the church 42 days after the lease was entered into.

The church claimed in a statement of claim filed in court, that it entered into a 12 months land lease agreement with Hilda Ngosi and Grace Tembo Lontia on October 1, 2017 but that 42 days after signing the lease, the two engaged an agent to issue a notice terminatin­g the agreement.

“On 16 November 2017, in total breach of clauses 2 and 4 of the lease, the land owners issued a notice of terminatio­n of the said lease agreement,” the charge claimed.

The church further claimed that on December 28, 2017, the two women in the company of ten unruly persons went to the leased premises to forcefully evict church members of staff and in the process damaged door locks with a grinder and also forcefully entered the buildings through windows.

It was further alleged that the accomplice­s were not only unruly but also kept threatened members of the church whilst pushing their way round the premises.

The church indicated that the land owners’ actions were in complete breach of the lease agreement and they should therefore be held liable for damages caused because of their misconduct.

Now the church seeks an order that the purported terminatio­n of lease is null and void and cannot be enforced

That the lease executed cannot be terminated without compliance with the terms of agreement and the laws of Zambia.

Further an order of injunction to restrain the land owners or their agents from any way violating the lease which entitles the church peacefully enjoy the tenancy of the lease premises without any interrupti­on.
