Post allowed to file application
LUSAKA High court Judge Sharon Newa has asked the Post News Papers Limited (in liquidation) to file an application challenging worries that it has discontinued the matter in which it was a party to proceedings meant to set aside the Consent order that declared the company wound up.
Ms Justice Newa made the order yesterday when the matter came up for inter party hearing.
This is in matter where the Post Newspaper editor- in-chief Fred M'membe and the Post Newspapers Limited had applied to stay the execution of a consent judgment that ordered the liquidation of the company for being illegal and fraudulently obtained.
Ms Justice Newa made the order following a request by the liquidator for guidance in the proceedings in view of the notice to discontinue the proceedings.
“I order that the plaintiffs file an application challenging the said notice to discontinue the matter and I will proceed to hear the said application before any further action can be taken in the matter," she said.
The liquidator had asked the court why State counsel Nchima Nchito indicated that he was acting for the Post saying they needed to respond because that was going to the root causes of the action.
Judge Newa further ordered that the Zambia Revenue Authority-ZRA-should be served with proceedings as they were not served earlier before the court set the date for ex parte hearing.
In the main matter, Mr M’membe and the Post Newspaper limited sued the Zambia Revenue Authority and the five former Post employees - Abel Mboozi, Roy Habaalu, Andrew Chiwenda, Mweembalubi Mweene and Bonaventure Bwalya - who commenced an action requesting the court to wind up the company.
