CHIEF SUES 3 SUBJECTS OVER LAND DISPUTE
By CHINTU MALAMBO CHIEF Mukumbwanyama of Chief Mungule’s area in Chibombo has sued three of his subjects in the Lusaka High Court seeking an injunction to restrain them from encroaching on unauthorised land.
Mr Daniel Mukumbwanyama who has been headman since 1959 indicated in a statement of claim filed in court that Richard Chiposi, Alex Hangoma and Enoch Chiposi illegally re-allocated land without authority.
Headman Mukumbwanyama claimed that in 2008, the defendants approached him to settle in the village on the customary land and that he gave them 1 acre piece of land.
He alleged that sometime in 2017, Richard Chiposi and Enoch Chiposi illegally allocated land to Alex Hangoma without his authority.
“The three in 2008 approached me because they wanted to settle in the Mukumbwanyama village on the customary land but in July 2017, the 1st and the 3rd defendants illegally allocated land to the 2nd defendant without authority from the chief or I the village headman on our land,” he indicated.
Headman Mukumbwanyama claimed that the three re-allocated themselves by encroaching on the land where they have built some houses and started farming activities on the disputed piece of land. He alleged that despite several attempts to stop his subjects from further occupying the land, all efforts have failed.
Headman Mukumbwanyama claimed that the trio had refused or neglected to adhere to his claims hence the suit.
And now Headman Mukumbwanyama seeks the courts indulgence for an order of specific performance.
He also seeks an order of injunction to restrain his subjects, their agents or anyone from building or farming on the disputed land until the matter is determined by the court.
He is also requesting that the court grants any other relief it deems fit.
