LCC, Zambeef sued over land
By SIMON MUNTEMBA A LUSAKA resident has sued Lusaka City Council (LCC) and three others for allegedly encroaching on his land in Matero East Township.
Simon Mapulanga, 45, who is PF Lusaka district secretary, sued LCC as first respondent, Zambeef Products plc as second, Godfrey Mwamba third and Obvious Banda as forth respondent respectively for allegedly encroaching on his Matero East plot no. 183/39.
Mr Mapulanga sued the local authority as first respondent for what he termed as “playing double standards” and failing to resolve a wrangle over the said piece of land he was given by LCC in 2006.
The plot in question has allegedly been encroached on causing him to lose 11 m x 44 m from the total 38 m x 44m plot.
The 3rd and 4th respondents, Mr Mwamba and Banda who also have legal documents from the LCC are accused of encroaching on the land in question which is on Great North road near Heroes stadium.
Mr Mapulanga sued the respondents late last year asking the court of law to restrain and bar them from encroaching on his plot and was granted an order for interim injunction until determination of the main case or any other order of the Lands Tribunal.
According to the court documents made available to the Daily Nation dated December 14, 2017, the Lands Tribunal Holden at Lusaka ordered for an interim injunction restraining the respondents from encroaching on the plot in question.
