RTSA wants Turnkey Solutions case dismissed
THE Road Transport and Safety Agency (RTSA) has asked the Lusaka High Court to dismiss a matter in which it was sued by Turnkey Solutions (Z) Limited, arguing that the entity that was sued is the Road Traffic and Safety Agency and not RTSA.
In an affidavit in support of summons to set aside writ of summons and statement of claim for irregularity, RTSA deputy director Gladwell Banda argued that the action was commenced against and entity which did not exist.
Mr Banda said on March 7 2018, RTSA was served with writ of summons and statement of claim but upon perusal of the documents, he noticed that Turnkey Solutions sued Road Traffic and Safety Agency and not RTSA.
Turnkey Solutions Limited sued the Road Traffic and Safety Agency ‘RTSA’ and the Attorney General seeking a declaration that the decision to award a contract to another party without cancelling the procurement process with it was procedurally wrong and unequitable.
And Turnkey Solutions is also seeking damages for misfeasance in public office by RTSA chief executive officer Zindaba Soko. In a statement of claim filed in the principal registry, Turnkey Solutions stated that around 2010, it submitted an unsolicited proposal to the Zambia Development Agency (ZDA) for the introduction of an electronic system on Build Operate and Transfer (BOT) basis under the Public Private Partnership (PPP) framework.
