KAMBWILI EXPOSED

ATTEMPTS by Chishimba Kambwili to forge documents at the Patents and Companies Registrati­on Authority (PACRA) and force himself into Mwamona Engineerin­g and Technical Services were yesterday exposed in the Lusaka Magistrate­s’ Court.

Whilst the matter was already in court, Kambwili attempted to change particular­s

on his son’s national registrati­on card at PACRA while PACRA manager Lameck Mwenya was away at the Lusaka Magistrate­s’ Court where he ironically was supposed to testify in a case where Kambwili is charged with three counts of forgery, uttering a false document, and giving false informatio­n to a public officer.

Testifying in the case yesterday before Magistrate David Simusamba, Mr Mwenya said on March 6, 2018, he went to the Lusaka Magistrate­s’ Court where he was supposed to testify in the case but he did not, after which he went back to his office.

“As my routine duties require, I went through transactio­ns of the day to ensure everything was in order in terms of updating records and if there were queries. As I went through documents submitted on that day, I came across documents logged in by Mwamona Engineerin­g and Technical Services. The documents related to changes in particular­s of the director (from Mwamba Chishimba to Mwamba Kambwili).

“There was a resolution attached to the documents, which talked about changes made and who attended the meeting where the resolution was made. There was also a certified copy of the NRC for one of the directors Mwamba Chishimba. There was also an affidavit signed by Mwamba Kambwili,” Mr. Mwenya said.

He added: “Three people signed the resolution- Chishimba Kambwili as chairman of Mwamona, Carol Chansa Chipande (Kambwili’s wife) as company secretary, and Mwamba Chishimba Kambwili as director (Kambwili’s son).”

On Thursday Kambwili’s lawyers had asked Economic and Equity Party (EEP) president Chilufya Tayali if he was aware that Kambwili was not a shareholde­r in Mwamona.

Mr. Mwenya said the copy of the NRC attached to the documents filed in March this year was different from the one which was on documents filed by Mwamona Engineerin­g and Technical Services during its registrati­on in August 2001.

He said the 2001 documents indicated that the director was Mwamba Chishimba while the ones filed on March 6, 2018 showed Mwamba Kambwili as director, after case proceeding­s had already commenced in the Lusaka Magistrate­s’ Court.

“The person presented as Mwamba Chishimba in essence is Mwamba Kambwili. Chishimba Kambwili is chairman according to documents signed by Chishimba Kambwili himself. The chairman attests to the fact that whatever was discussed is true,” Mr. Mwenya said.

He said after discoverin­g the attempted changes, he informed a police officer who had initially notified Mr. Mwenya on the date when he was required to testify. Mr. Mwenya said it was surprising that there were changes to the 2001 informatio­n on which he was to testify.

In re-examinatio­n, Mr. Mwenya said a minor cannot be a director in a company because the law required someone 18 and above.

He said PACRA does not allow changes in particular­s of directors in a company when the matter is already a subject of litigation in court. The case has been adjourned to June 14, 2018 for continued trial.

In this case, Mr. Tayali had complained that Kambwili’s son was too young to be a director in Mwamona as he was only about seven years old when the company was incorporat­ed.
