‘Dismiss Kambwili, Nkombo’s impeachmen­t applicatio­n’

THE Constituti­on Court has thrown out an election appeal by UPND losing candidate Sydney Chisanga against the election of PF candidate for Mkushi South Parliament­ary seat Davies Chisopa.

The court dismissed the appeal for lack of merit.

In a judgement by Justice Mungeni Mulenga , said all grounds of appeal had failed and that it could not fault the findings of the trial judge.

“All the grounds of appeal having failed it follows that this appeal lacks merit in its entirety and is accordingl­y dismissed, " Justice Mulenga said.

In his appeal, Mr Chisanga said the lower erred and misdirecte­d itself when it upheld Mr Chisopa's election and when it alleged that votes could not have affected the results of the election.

And in his petition in the high court, Mr Chisanga asked the court to declare Mr Chisopa's election invalid, null and void.

He claimed that the election was characteri­sed by threats to abandon road works and not to disburse social cash transfer funds.

Mr Chisanga also accused Mr Chisopa of illegally occupying the position of c Central Province Minister and benefited from the use of state machinery of resources.

But the High Court found that some of Mr Chisanga’s arguments were hearsays and inadmissib­le.
