Meanwood objects to land case disjoinder
…insists Victory Ministries trustee must explain his role in court
MEANWOOD property development has opposed an application to disjoin former trustee of Victory ministries, Cosmas Mwananshiku to a matter in which MMD faction leader, Dr Nevers Mumba and two of his trustees have been sued for allegedly selling land belonging to UPND leader Hakainde Hichilema and another person.
Dr Mumba was sued in his capacity as Victory Ministries International president together with his trustees Mr Mwananshiku and Ms Charity Daka.
Mr Mwananshiku however, said he was not part of the team which was tasked to sell the land neither was he involved in negotiating the price for the property.
But Meanwood argued that Mr Mwananshiku had not provided any evidence to show that he was no longer a trustee at Victory Ministries International or that he did not play a role in the sale.
It argued that Mr Mwananshiku was sued for the role he played when he executed the assignment on behalf of Dr Mumba, therefore he is answerable for his acts.
Meanwood states that despite approaching the defendants in order to settle the matter amicably, Dr Mumba, Mwananshiku and Ms Daka had failed to agree with Hichilema and lawyer Marshal Muchende who also claim ownership of part of the land.
It further prays that Mr Mwananshiku should not be removed from the proceedings because he has to explain the role he played at trial.
Meanwood claims damage for loss of business, costs and any other relief that the court may deem fit.
