Client sued over unsettled legal fees

By NATION REPORTER A LAW firm has sued a client for refusing to settle K600, 000 legal fees after successful­ly winning a case in the Supreme Court.

Robson Malipenga and Company dragged Yusuf Anthony Filamba to the Lusaka High Court claiming that it has suffered loss and damage.

The firm claimed in its statement of claim filed in court that it successful­ly obtained judgement in favour of Mr Filamba in the High Court under cause number 2007/HP/ 0654 were he was claiming a piece of land in Chelstone.

It claimed that it also represente­d Mr Filamba under cause number 2007/HP/0654 when he appealed to the Supreme Court and again successful­ly obtained judgement in his favour.

“We were appointed as advocates for Mr Filamba in August 2007 under cause number 2007/ HP/0654 where he was claiming a piece of land, stand NO. 1258 in Chelstone. We successful­ly obtained judgement in his favour in the High Court.

“Mr Filamba under cause number 2007/HP/0654 appealed to the Supreme Court and we were again retained to act for him. We successful­ly represente­d him and judgement was in his favour,” the law firm claimed.

The law firm claimed that at the time Mr Filamba was appealing to the Supreme Court, he had already built a full house and continued to get rentals.

It indicated that Mr Filamba through his lawyers wrote a letter proposing that the house be sold to cover legal fees taking into considerat­ion the fact that his interest at first was only bare land.

The firm claimed that it issued Mr Filamba a bill of K600, 000 for works done from the High Court to the Supreme Court but he refused to settle it.

And now the law firm wants the High Court to order the sale of the house, payment of K600, 000 or alternativ­ely an order for taxation.

It also wants costs, damages and interest on current bank lending rates.
