PF councillor, 4 others sued over land
A PATRIOTIC Front councilor Silvester Mulenga and four suspected PF cadres have been dragged to the Lusaka High Court for illegally encroaching on someone's piece of land which is being used as a car wash. Land owner Frank Mwanza trading as Frank White Enterprise has also sued the Lusaka City Council for entering another lease agreement with the cadres over the same land He asked the court to declare that he was the bonafide owner of the said property situated along Kaunda Square Road behind Munali Secondary School. Mr Mwanza sought damages for loss of use of property from February 2016. In his statement of claim Mr Mwanza wants an order of interim injunction restraining the accused who include George Sokoni, John Silungwe, Josias Ngulube and a Mr Melu from interfering with the quiet enjoyment of his car wash. He claimed that the councillor and the cadres arrogantly took possession of the property after they purportedly entered into a lease agreement with the council, which lease was made on December 29, 2017 after he was offered the land. Mr Mwanza said efforts to stop the defendants from interfering with the property had failed due to impunity, rudeness and using the name of the party as they were using the PF secretariat letter head in their correspondence to the council. Further Mr Mwanza claimed that he acquired the premises to use for three years starting from February 26, 2016.
