Milingo sues over lost property
EXCOMMUNICATED Roman Catholic Bishop Emmanuel Milingo has sued the Zambia Helpers Society, in the Lusaka High Court accusing the organisation of fraud after it allegedly transferred and registered his personal properties without his consent and expelling him from the organisation.
Bishop Milingo, who was the Chairman of the Society also dragged Delax Derrick Chilumbu, a trustee of the Society to court for allegedly signing a mediation settlement order on his behalf.
In a statement of claim filed in court, the clergy man stated that he was unlawfully expelled from the board of the Zambia Helpers Society contrary to the Constitution of the Society.
He claimed that the Society prepared and completed Deeds of Gift relating to subdivision B of farm No. 456a, Lusaka and subdivision C of farm 456a, Lusaka without his consent. He said the Society also registered them without his authorization.
Bishop Milingo further claimed that by virtue of his expulsion from the Society and fraudulent transfer of his property, On September 3 2014, he commenced an action in the High Court challenging the unlawful acts.
He claimed that he did not sign the deeds that purported to transfer the property to the Society and that he had no intention of gifting his property.
Bishop Milingo wants the Mediation Settlement Order to be declared null and void.
He also wants an order that his expulsion from the Society is null and void.
Bishop Milingo further wants an order of cancellation of certificates of title relating to the said properties as they were registered on Deed of Gift procured by fraud.
