Witness lost temper on seeing suspect - cop who

A POLICE officer has told the Kitwe High Court that a Tanzanian, whose truck laden with copper cathode was stolen, broke down as he identified one of the suspected robbers.

Detective Inspector Lloyd Chibale narrated that Rajab Rashid could not hold his emotions when he identified Chilufya Chipili as the person

robbed him of the K1.8 million worth of copper cathode.

Mr Chibale said the two Tanzanian witnesses positively identified Chipili who is first accused person in this matter.

This is in a case involving Daniel Makina Chinyama, 35 of Kitwe and a Chililabom­bwe taxi driver, Chipili 32, who are charged with aggravated robbery. On August 28, last year the two while armed with pistols are alleged to have stolen copper cathode values at K1.8 million.

Mr Chibale told Kitwe High Court judge-in-charge, Timothy Katenekwa, that on September 7, last year he was assigned to conduct an identifica­tion parade in the case of aggravated robbery. He said he had two witnesses, Rashid Rajab and Mwanji Musamba, while one suspect was detained in custody. He said he arranged nine men of the same height and similar body type for the parade including the suspect, Chipili. Mr Chibale said both witnesses identified Chipili as the person who had stolen the copper cathodes.

Mr Chibale said the parade which started around 13:40 ended at 14:10 and that Chipili had two relatives present and had no complaints.

Another witness, Chief Inspector Simon Chushi told the court that Mr Rajab grabbed a suspect as he broke down during an identifica­tion parade.

Mr Chushi said there was commotion during the identifica­tion parade when Mr Rajab was identifyin­g the suspect as he could not hold his emotions and anger when he saw Chipili. He said officers on the parade helped calm the situation and took Mr Rajab away as he wanted to beat Chipili. Mr Chushi said after the witness was calmed down by officers he positively identified the accused and was then taken away from the parade.

Mr Chushi said the second witness Muhammad Hamuzala also identified Chipili.
