Chinese sues Lusaka businessma­n over Mukula logs shipment

A CHINESE national has dragged a Lusaka businessma­n to the Lusaka High Court for allegedly failing to honor an agreement where he was supposed to procure and process the shipment of Mukula logs to China.

Yi Shi Lei claimed that Emmanuel Jay Banda, a resident of Lusaka breached their agreement which the two entered into on April 5 2017.

Mr Lei stated in a statement of claim filed in court that after receiving US$117, 150 to facilitate for shipment of Mukula logs to China and having failed to do as agreed, Mr Banda had been reluctant to refund him.

“In breach of the agreement the defendant has failed, neglected and refused to honor his obligation after having received the amount, prompting the plaintiff to demand the refund of the same monies which the defendant undertook to refund by paying instalment­s after every two weeks and this was after seeing that the plaintiff reported the matter to the police and has to date only paid US$3,700.00 leaving a balance of US$113,450. 00,” read part of the claim.

Mr Lei claimed that he has suffered loss and damage as a result of Mr Banda’s conduct.

He stated that several at tempts had been made to have the matter settled out of court but Mr Banda has neglected and refused to do so.

Now Mr Lei wants the court to order Mr Banda to pay him US$113, 450. 00 and damages for loss of use of the money which was intended from April 2017 to date.

He also wants damages for breach of agreement, interest and any other reliefs that the court may deem fit.
