HPCZ wants Mujajati’s case dismissed
THE Health Professionals Council of Zambia (HPCZ) has told the Lusaka High Court to dismiss a matter where its former registrar Aaron Mujajati has sued it claiming over K800, 000 for termination of his contract of employment.
In January this year, Health Minister Chitalu Chilufya announced the termination of Dr Mujajati’s contract of employment as HPCZ Registrar. Dr Chilufya disclosed that the Civil Service Commission had redeployed Dr Mujajati to Ndola Teaching Hospital, as a consultant. HPCZ acting registrar Bwembya Bwalya, however, in his summons to determine matter on a point of law pursuant to order 14 a rule 1 of the rules of the Supreme Court argued that Dr Mujajati should not have sued HPCZ but the minister of Health. Mr Bwalya claimed that Mr Mujajati’s appointment was recalled by the Ministry of Health. He claimed that HPCZ paid Dr Mujajati his gratuity for the period served and that they do not owe him anything and as such he had no cause of action against the council. In this matter Dr Mujajati took legal action against HPCZ seeking re-instatement to his position. According to his statement of claim filed in court the former Registrar contends that in January this year, Health Minister Chitalu Chilufya announced his the termination of his contract of employment as HPCZ Registrar. Dr Mujajati is also claiming for leave days, damages for loss, inconvenience and mental stress among other reliefs.
