Lawyer, 2 others deny charges over Baobab land

LUSAKA lawyer Germano Kaulung’ombe and two others have denied six charges slapped on them over their alleged attempt to illegally sell plots at Baobab land to National Pensions Scheme Authority (NAPSA) directors.

Kaulung’ombe, 55, of plot 255 G Close, Avondale, his legal assistant Stanley Tembo, 50, of house number 26 Palm Drive, Chelstone, and Leonard Mapulanga Nyoni, 37, of Farm number 4300, Makeni, denied the charges before Lusaka Chief Resident Magistrate Lameck Mwale yesterday.

In the first count, the three have been charged with forcible detainer, contrary to Section 87 of the Penal Code Chapter 87 of the Laws of Zambia.

Particular­s of the offence are that between July 18 and 23, 2019 in Lusaka, the three had possession of farm number F/4300/B/2 in Baobab area without colour of right and held possession of such land in a manner likely to cause breach of peace against Joseph Chisaka, a person entitled by law to have possession of the said land.

In the second count, the accused persons have been charged with obtaining money by false pretence, contrary to Section 309 of the Penal Code.

Particular­s of the offence are that between July 18 and 23, 2019 in Lusaka, the three with intent to defraud or deceive obtained K200, 000 cash from Ronnie Kamanya by pretending that they had a plot for sale when in fact not.

In the third count, the accused persons face the charge of obtaining goods by false pretence, contrary to Section 309 of the Penal Code.

Particular­s of offence are that between July 18 and 23, 2019 in Lusaka, the three with intent to defraud or deceive obtained K100, 000 cash from Dorothy Phiri Soko by pretending that they had a plot for sale when in fact not.

In count four, the three have been charged with obtaining money by false pretence. It is alleged that between the same dates, they jointly and whilst acting together with intent to deceive or defraud obtained K100 000 cash from Marson Moonga on the same pretence.

In the fifth and sixth counts, it is alleged that between the same dates the three accused persons obtained the same amounts of cash from Phillip Muyumbwana and Utembele Simwinga on the same pretence. The court has set September 3, 2019 as the date for start of trial.

In the same court, the State told Mr. Mwale yesterday that it was not ready to proceed with trial in the case Chisamba farmer Douglas Quentin Watt and a grade 12 pupil Mwila Davis Chilufya have denied two counts of having carnal knowledge of each other.

The State also informed the court that the Director of Public Prosecutio­ns has not yet given consent to prosecute the two for two counts of possessing obscene pictures and videos.

In the second count, the accused persons have been charged with obtaining money by false pretence, contrary to Section 309 of the Penal Code.
