CHAMINUKA Wildlife Estate Limited has been sued by two joint buyers of a portion of land in the wildlife sanctuary, claiming a refund of over US$500, 000 and damages for breach of contract.

Mutale Mukuka and Adela Rukra Debeer are asking the Lusaka High Court to declare that Chaminuka Wildlife Estate Limited has repudiated (rejected) the contract of sale of 2015. The contract related to a sub-division of the reminder of farm 1878 in the Chaminuka areas of Chisamba district.

Mukuka and Debeer want a court order for the refund of US$570, 000 following the repudiatio­n as well as special damages being the total monies that the duo invested in developing the property.

They are also seeking damages for inconvenie­nce, damages for anxiety, interest on the aforesaid sums. The two say in their statement of claim filed on November 5, 2019 in the Lusaka High Court registry that they were at all material times joint purchasers of the land in the Chaminuka Wildlife Estate while the defendant was at all material times a liability company carrying on business of property developmen­t, amongst others.

They stated that sometime in 2015, they jointly entered into the contract for the sale of land with Chaminuka Wildlife Estate Limited.

“By this contract, the defendant is the vendor whilst the plaintiffs are purchasers. The plaintiffs will at trial refer to the said contract for its full contract,” reads the statement in part. They state that all efforts to have Chaminuka Wildlife Estates Limited to deliver and facilitate the delivery of certificat­e of title have failed.
