Accountant demands K800, 000 for torture

AN accountant at MTN Zambia has sued the Attorney General and a police o cer in the Lusaka High Court demanding K800,000 compensati­on for alleged illegal imprisonme­nt and torture after his arrest on Thursday last week.

Hamanyanga Kaseele said he was unlawfully arrested by a Mr Mutono, a police officer when he was at his workplace and that upon his arrest, no reasons were given to him but was immediatel­y take to Chelstone Police station.

Mr Kaseele said in his statement of claim filed in court that upon his arrival at the police station, Mr Mutono directed his subordinat­es to torture him by way of handcuffin­g him and beating him on his legs and head with an iron bar and short baton.

He said Mr Mutono oined the police officers who were torturing him and participat­ed in the torture. Mr Kaseele said when he asked the basis of his torture, Mr Mutono increased the torture and put electric cables on his body and switched on the power so that he could be electrocut­ed and was electrocut­ed briefly.

Mr Kaseele said he will show at trial that he had been badly injured due to the consistent torture and inhuman treatment he had been subjected to and that Mr Mutono had refused to take him to the hospital or allow his parents to visit.

He said Mr Mutono had continued to threaten his life and had undertaken to ensure he did not leave the police station alive.

Mr Kaseele said he would show at trial that from the time he was detained, Mr Mutono had not been able to furnish any reason for the detention or the torture.

He said he would also aver and prove at trial that the Mr Mutono had no legal right to torture him or inflict pain or in ury on him.

My Kaseele claimed that by reason of what was happening to him, he was living in fear.

And now he claims an order of interim injunction restrainin­g Mr Mutono through his agents or servants or whomsoever from torturing, threatenin­g his life or doing anything calculated at directly affecting him.

He also wants an interim order compelling Mr Mutono through his agents or servants or whomsoever to take him to the hospital and allow him seek medical attention in the presence of his parents.

Mr Mutono also wants an order compelling the police to allow his parents, relatives and family members to visit him at the police station.

He further wants compensati­on of , for torture, pain , internal injuries and chest injuries.

Mr Kaseele further demanded compensati­on of , for wrongful arrest, false imprisonme­nt and detention and any other reliefs that the court may deem fit.
