I SIGNED PAPERS FOR MY SON, ADMITS KAMBWILI

CHISHIMBA Kambwili yesterday admitted that it was his signature that was on documents purported to have been signed by his son, but claimed that he had been given power of attorney to do so.

He admitted that the disputed signature on the document was his and that there was no way he could forge his own signature.

He denied that he forged a “no change return (company’s form 71)” because he allegedly got power of attorney from his son Mwamba who was at a university in the United Kingdom.

Kambwili said his wife Carol was equally in the United Kingdom but that the company had to continue running, hence his son’s instructio­ns to him to sign documents on his behalf.

Kambwili was found with a case to answer for chairing the meeting that fraudulent­ly decided to change particular­s of his company long after the forgery case had started.

Evidence presented to the court establishe­d that the national registrati­on card (NRC) number 239643/68/1, which was used for registrati­on of the company in 2001, had been replaced by NRC number 306414/68/1.

His son, Mwamba had also been removed as company secretary for Mwamona

Engineerin­g Technical Services Limited and replaced by Carol Chansa Chipande (Kambwili’s wife).

Testifying in the contempt case before Magistrate Nsunge Chanda on Tuesday, investigat­ions and arresting officer, Stanley Mumbula said in the documents lodged at the Patents and Companies Registrati­on Agency (PACRA) after a court sitting in the main matter before Principal Resident Magistrate David Simusamba, the name Mwamba Chishimba had been removed and replaced by Mwamba Kambwili.

In the main case, Kambwili has been accused of using his sister’s NRC to show that it belonged to his son Mwamba who was a minor in 2001.

“These were the notable changes and therefore being investigat­ions and arresting officer in another case, I noticed that the informatio­n changed,” Mr. Mumbula said.

Mr Mumbula also said resolution­s to change the particular­s for directors and shareholde­rs were passed on March 5, 2018 and the meeting was attended by Kambwili, his wife Carol Chansa Chipande, and his son Mwamba.

He said Kambwili chaired the meeting which included his wife and Mwamba and there being no any other business it was closed at 07:30 hours.

“As investigat­ions officer those changes affected facts that were before Honourable Simusamba. If somebody goes to PACRA wanting to find out directors and particular­s of shareholde­rs they will find something different.

“For me who had investigat­ed the matter before, we will appear like we presented false facts. When this matter was brought to my attention I got interested and brought these documents to the prosecutio­n team,” Mr Mumbula said.

Yesterday, irate cadres yesterday almost lynched Economic Equity Party (EEP) president Chilufya Tayali who had turned up to attend the forgery case of Kambwili.

Kambwili’s supporters were incensed over a Facebook post attributed to Mr. Tayali in which the latter allegedly said the NDC leader yesterday presented to court his son’s alleged forged birth certificat­e.

This was after Kambwili opened his defence before High Court Deputy Registrar David Simusamba who sits as Principal Resident Magistrate in the matter.

As Kambwili was giving his defence, one of his lawyers Christophe­r Mundia informed Mr. Simusamba that Mr. Tayali had uploaded on his Facebook an allegation that the NDC leader had presented the alleged forged birth certificat­e for his son Mwamba as part of his evidence.

Mr. Mundia and other defence lawyers Keith Mweemba, Gilbert Phiri, and Musa Mwenye, asked the court to deal with Mr. Tayali summarily for alleged contempt in the court’s face.
