NAPSA drags traffic firm to court

…claims K141, 000 statutory funds

NATIONAL Pension Scheme Authority (NAPSA) has dragged Intelligen­t Mobility Solutions Limited (IMS) to the Lusaka High Court, claiming K141, 000 in respect of penalty arrears.

The social security firm contends that IMS allegedly remitted monthly contributi­ons late.

NAPSA is claiming payment of K141, 760.07 in respect of penalty arrears as a result of non or late contributi­on of penalty arrears.

It also wants interest, damages, costs and any other relief the court may deem fit.

In a statement of claim, NAPSA stated that despite several reminders on the mandatory requiremen­t to comply with the law, IMS had neglected to pay the sum of K141,760.07.

The matters is before the Lusaka High Court.

"That if the aforementi­oned payment is not made within the stated time limit, such a payment would attract a 20 percent cumulative penalty for each month.

“IMS has been remitting monthly contributi­ons albeit late, as a result IMS has accumulate­d debt in penalty arrears in the sum of K141,760.07," read the claim.

NAPSA stated that it was a statutory body whose principal function was to implement policy relating to the National Pension Scheme and control and administer the scheme.

It added that it was by law mandated to collect monthly statutory contributi­ons from contributi­ng employers.

NAPSA stated that IMS was a statutory body establishe­d under the provisions of the Road Traffic Act No.11 of 2002.

It stated that it shall state at trial that IMS was a contributi­ng employer registered as a Tax Payer with contracts of service with employees under the National Pension Scheme Act No.40 of 1996.

NAPSA further stated that IMS was mandated to pay to the National Pension Scheme a contributi­on in respect of its employees in its employment at the end of each month.
