Vehicle case of ex- MP’s wife rages
THE State has asked the court to order cross examination of former Katuba Member of Parliament Bampi Kapalasa's wife, Fanny Madzi, to give an explanation on how ownership of the motor vehicle changed from Swift Cargo and Services Limited to her name.
It contends that Ms Madzi has failed to give an explanation as to how ownership of an Isuzu D-Max registration BAP 6744ZM belonging to Swift Cargo was changed.
This will help determine whether the police were justified to impound the vehicle she claims is hers.
In this matter, Ms Madzi commenced judicial review proceedings in the Lusaka High Court against the decision by police to seize her Isuzu-D-Max which is alleged to be a gift to her husband from former Minister of Foreign Affairs Joseph Malanji.
The vehicle was seized by the Interpol theft of motor vehicles criminal investigations department, service headquarters.
She wants a declaration that the decision by the police to seize her vehicle was illegal and cited Attorney General Likando Kalaluka as the defendant in the case.
But the police stated that Swift Cargo allegedly reported that Mr Kapalasa had fraudulently obtained its vehicle.
The State wants Ms Madzi to be cross examined to get to the factual dispute of the matter.
"It is our contention that justice requires that the court allows for answers to be given as to how the applicant came into having documents of ownership of this vehicle, in determining whether the respondent was justified in its decision to impound the vehicle.
“It is thus our prayer that this honourable Court allows for the applicant to be cross examined and for the respondent's witness to give viva voce evidence at the hearing of this matter," the State submitted.
