China Geo sues Mable’s African creations for trespass
CHINA Geo Engineering Corporation has sued Mable’s African Creations Limited seeking a declaration that it has the legal right to the land in Chongwe where it operates a Quarry.
The Chinese investor wants an order of injunction as well as interim injunction retraining Mable’s African Creation from trespassing, forcibly ejecting China Geo from the land, thus violating its quiet enjoyment.
It wants Mable’s Creations prevented from blocking roads leading to the property, removing, selling, transferring, seizing or utilizing any of its equipment, machinery or Asphalt Plant.
China Geo wants damages for trespass, intimidation, inconveniences in its operations and loss of man hours due to work stoppages as well as refund of all consequential expenses arising from Mable’s African Creations conduct.
It also wants interest on amount found due by the Lusaka High Court and payable from the date of writ to judgement.
According to a statement of claim, China Geo stated that by a Memorandum of Understanding dated December 20, 2012, it was offered the said land by the Busoli Royal Establishment at Muzembela Village on which it constructed a Quarry from the embryonic stage which is now referred to as Njolwe Quarry .
It stated that the land was acquired for the purposes of mining granite for use in the road construction from Lusaka to Chirundi via Chiawa in Lusaka as it has throughout the period in issue been involved in road construction by virtue of a contract awarded to it.
