Federal Party sues over registration
THE Federal Government Party (FGP) has sued the Chief Registrar of Societies for declining to re-register the party.
FGP president, Patrick Mpundu, wants to commence judicial proceedings against the decision of former Minister of Home Affairs Steven Kampyongo to decline the re registration of the party in accordance with section 134 of the Societies Act.
Attorney General Likando Kalaluka and Chief Registrar of Societies are first and second respondents respectively.
Major Mpundu wants the Lusaka High Court to quash the former minister’s decision not to re-register the party.
He was also seeking a declaration that the method, procedure and process used by the respondents to arrive at the decision were illegal and procedurally improper.
He also wants a declaration the party was entitled to re-registration in accordance with section 124 of the Societies Act Cap 119 of the laws.
Maj Mpundu stated that after the party was de- registered, an application was made to the Chief Registrar for the party to have its certificate of registration restored by way of re-registration.
“However, the Registrar denied us our statutory rights to re-registration by citing reasons that are illegal, procedurally improper and manifestly irrelevant.
“The Minister of Home Affairs unfortunately upheld the decision of the registrar and in doing so, he followed a path of reasoning which too was illegal and procedurally improper,” Maj Mpundu stated.
