PF records mixed fortunes in court
PF yesterday experienced mixed fortunes in court where some election petitions were upheld and others lost.
The Kitwe High Court has upheld the election of Ms Kampamba Mulenga as Member of Parliament for Kalulushi Constituency.
Kitwe High Court Judge-in-Charge Charles Chanda declared that Ms Mulenga was duly elected because the petitioner, Ms Rashidah Mulenga failed to discharge the onus of proving the allegations to a fair high degree of convincing evidence as per the provision of the Electoral Act.
This is in a matter in which Ms Mulenga petitioned the election of Ms Kampamba Mulenga claiming bribery, vote buying among other electoral malpractices. Ms Mulenga stood as an independent candidate in the August 12, 2021 general election.
But during the five-hour judgement yesterday, the court found that the allegations were not proven as most of them were based on hear-say.
And the Kasama High Court has nullified the election of PF’s Taulo Chewe as MP for Lubansenshi Constituency.
And the Kasama High Court has upheld the elections of George Chisanga and Robert Kalimi as Members of Parliament for Lukashya Constituency in Kasama District and Malole Constituency in Mungwi district.
In Ndola, the High Court dismissed the election petition against Masaiti Member of Parliament Michael Katambo which was filed by losing UPND candidate Shevy Mukabila.
And the Chipata High Court dismissed a petition against Vubwi PF MP Ackleo Banda by losing UPND candidate Alphonso Phiri.
The court also declared Kapoche PF MP Luckson Lungu as duly elected.
It also upheld the election of Msanzala PF MP Elias Daka, Sinda PF MP Masauso Tembo and Lumezi independent MP Munir Zulu.
The court also upheld the election of Chadiza PF MP Jonathan Daka and Kasenengwa PF MP Philimon Twasa.
