Sibongile fights for Kasama Central

KASAMA Central member of Parliament Sibongile Mwamba has appealed against the Ndola High Court’s decision to nullify her seat following the petition filed by losing UPND candidate Rodrick Chishimba Chewe.

In her grounds of appeal filed in the Constituti­onal Court, Ms. Mwamba said Judge Emelia Sunkutu, who sat in Mansa on November 25, 2021, erred in law and fact when she admitted as part of Mr. Chewe’s evidence matters that were not pleaded even after the same were objected by both Ms. Mwamba and the Electoral Commission of (ECZ) but instead the judge guided that she would address the same in her judgment when the same should not have been entertaine­d in the first place or when the same not have been allowed to Grace the court record.

She says Ms. Justice Sunkutu erred in law and fact when she found that Ms. Mwamba knew of Chishimba Kambwili’s alleged tribal sentiments when to the contrary there was no evidence on record that had shown that indeed Ms. Mwamba listened to the radio program or that it was done with her knowledge or that of her election agents but to the contrary there was evidence that Mr. Kambwili’s said sentiments were mainly made for and concerning then President Edgar Chagwa Lungu and President Hakainde Hichilema who were respective­ly presidenti­al candidates for the PF and UPND.

Meanwhile, losing UPND Sinda parliament­ary candidate Levy Ngoma has appealed against the High Court’s decision to dismiss his petition against Patriotic Front (PF) member of Parliament Masauso Tembo.
