Report gay cases for police to act- Mwiimbu

POLICE cannot take action without any evidence of the alleged homosexuality acts that has been happening in the country recently, Home Affairs and Internal security Jack Mwiimbu has told parliament.

Mr Mwiimbu said if there are no reports pertaining to gaysim and unnatural acts, police cannot do anything.

Mr Mwiimbu explained that police do not act on speculation, but , rely on evidence, therefore cases that have been reported with evidence are being investigated.

Mr Mwiimbu, during a ministerial statement, however disclosed that Zambia police service has recorded a total n,of 18 cases of sodomy countrywide as from January this year.

Mr Mwiimbu disclosed that, Lusaka province recorded seven cases, five arrests and two cases still under investigation, Copperbelt province seven cases reported , six arrests and one under investigation, Muchinga province one case reported and one arrest made.

He said Tazara division in Mpika one case was reported and one arrest and convicted for seven years imprisonment with hard labour, while in Eastern province one case reported and one arrest made the same as in Western province.

He also said the Lusaka July event for it to be a criminal offence there must be unnatural acts that would have happened like sodomy, gayism during the event, but there is no evidence and police can’t not act.

And Mr Mwiimbu added that section 155 of the penal code act chapter 87 of the laws of Zambia criminalizes sex between men and section 156 of the penal code act chapter 87 of the Laws of Zambia criminalizes any attempt to commit ‘unnatural offences’ prohibited under section 155;

Meanwhile, Police have disclosed that a post-mortem on the body of a male person alleged to have died after being sodomised in Lusaka’s Soweto market on Sunday showed that the man died as a result of assimilated tuberculosis in advanced Immunization and had an outgrowth on the anus.

Police spokesperson Rae Haamonga said the deceased has been identified as Daniel Kalale aged 32 a squatter at Soweto market.

Mr Haamonga explained that the deceased however was taken for treatment at Kalingalinga clinic on September 16, 2022 by Fortune Mukendi aged 44 another squatter at Soweto market.

He said shortly after arrival at the clinic he died and was taken to University Teaching Hospital (UTH) mortuary where the body was deposited.
