MAGISTRATE DISMISSES KAIZER ZULU APPLICATION TO HAVE PASSPORT RELEASED
LUSAKA magistrate Sylvia Munyinya has dismissed an application by former presidential aide Kaizer Peter Zulu to release his passport for him to seek medical attention abroad.
Zulu through his lawyer Joseph Chirwa, submitted to the court that he needed to access his passport to seek medical attention.
“Our client needs to access medical attention and is asking the court to release his passport,” Mr. Chirwa submitted.
However, when the matter came up for ruling yesterday, magistrate Munyinya dismissed the application saying the defense did not adduce any evidence in court in form of writing as a matter of urgency to state that the accused was sick and needed medical attention.
“Having considered the submission from the defence that the accused person needed to seek medical attention and other personal movements, and he has adhered to all the court rules of not missing court, I rule that the defense did not produce any evidence as a matter of urgency. The application to release the passport has been denied,” she ruled.
In this matter, Zulu pleaded not guilty to one count of failing to appear before the nearest immigration, one count of failure to surrender a diplomatic passport and one count of impersonating Public Officers contrary to the Laws of Zambia.
It is alleged in count one that Zulu on December 9, 2022 in Lusaka, did fail to appear before the nearest Immigration Office at a port of entry.
In count two, it is alleged that Zulu on unknown date but between December 20, 2019 and December 2, 2022 in Lusaka, without reasonable excuse, did fail to surrender his diplomatic passports No.D0012325 and D0012791 when required to do so by the Chief Passports and Citizenship Officer upon ceasing being a diplomat.
In the last count, Zulu on unknown dates but between August 8, 2022 and August 28, 2022 , did falsely represent himself to be a person employed in the public service as a diplomat to an Immigration Officer in Kenya.
The court has since adjourned the matter to April 3, 2023 for continuation of trial.
