ACC wants ‘Commander Two’ forfeit his property to State

The seized properties include his residentia­l house known as L/26392/M worth K2.5 million, L/26395/M K4.5 million, L/28477/M/J and L/28477/M/H, worth K3.4 million, all located off Great East road , Silverest ,Chongwe district.

ACC further wants the movable properties that where found at property L/26395/M valued at K461, 664, forfeited to the State.

The applicant submits that Muchemwa was an employ of

Minister of Health Silvia Masebo disclosed that government was putting up a plans to fumigate the whole Lusaka, Central Business District, Markets and the communitie­s around the district.

Ms. Masebo said government was trying by all means to put immediate interventi­ons as they are still waiting to secure more cholera

ZESCO and drew between June 1, 2015 and August 1, 2021, K483, 761.

ACC also establishe­d that ZESCO paid Muchemwa paid per diem for trips undertaken out of Lusaka and that the total sum of money earned between June 1, 2015 and August 1, 2021 was K141, 400.

This is according to an affidavit in support of originatin­g notice of motion for an applicatio­n for Non-Conviction Based forefeitur­e order of tainted property sworn by ACC investigat­ions officer, Claudia Chimfwembe Chibiliti filed in the Economic and Financial Crimes Court.

ACC has cited Muchemwa, his companies namely Altitude Properties limited, Friltech Networks Zambia limited and Massbreeds

Investment­s Zambia limited as first to fourth interested parties.

Ms Chibiliti stated that according to investigat­ions, the immovable properties were acquired between July 2020 and December 2021.

It was discovered that Altitude Properties limited and Friltech Networks Zambia limited filed no tax returns nor did they declare any income with Zambia Revenue Authority.

Ms Chibiliti establishe­d that between 2016 and 2020, total sales for the Frill Pub and Grill were K3, 428, 162, total expenses amounted to K 786,104 and the total profit was K2, 642,058.5.

“That with respect to the business name and style “The Frill and Grill’ ,I discovered that the 1st interested party (Muchemwa) ,had registered for turnover tax but that he is not compliant and in, some cases ,he filed nil returns thereby accruing penalties to the tune of K424,140.00,” she submits.

Ms Chibiliti contends that from her investigat­ions, the alleged total income of Muchemwa from his ZESCO salary, per diem, and the Frill Pub and Grill between 2016 and 2020 is K4, 934,912, whereas the total value of all his movable and immovable assets in which he has a direct interest is K12, 167,736.

She submits that the Value of total assets possessed is K13, 169,735 while the value of legitimate source stands at K4, 934,912 and value of unexplaine­d or suspected proceeds of crime is K7, 234,824.
