Sampa appeals High Court ruling that affirmed Nakacinda as PF secretary general

MILES Sampa has now turned to the Court of Appeal in his quest to overturn the High Court ruling which recognised Raphael Nakacinda as the Patriotic Front secretary general.

Mr Sampa has thus filed an applicatio­n in the Lusaka High Court, asking Judge Situmbeko Chocho to stay proceeding­s in a matter Mr Nakacinda and three others are challengin­g his election as PF president.

On January 29, 2024, Mr Sampa filed a memorandum of appeal into the Court of Appeal, contending that Judge Chocho erred in fact and law when she failed to pronounce herself on the issue of locus standi in relation to Mr Nakacinda. Mr Sampa had asked the High Court to dismiss the matter on the basis that Mr Nakacinda had no locus standi to commence an action on behalf of the PF as he was illegally appointed as secretary general by the acting president, Mr Given Lubinda.

In her ruling dated January 15, 2024, Justice Chocho however dismissed the applicant’s preliminar­y issue that sought for the removal of Mr. Nakacinda in his capacity as secretary general on basis of locus standi.

According to ex-parte summons for an order to stay proceeding­s pending determinat­ion of appeal by the Court of Appeal filed yesterday, Mr Sampa submitted that the appeal had high prospects of success.

If this court does not grant an order to stay proceeding­s in this matter, any ruling or order in my favour given by the Court of Appeal shall be rendered nugatory and an academic exercise. I am likely to suffer irreparabl­e damage and prejudice unless the proceeding­s before this court are stated,” he stated. Other plaintiffs in the matter are Mr Brian Munduible, Mr Mutotwe Kafwaya and Mr Greyford Monde.
