Milingo Lungu discontinues immunity case
FORMER Konkola Copper Mines (KCM) Provisional Liquidator, Milingo Lungu has terminated proceedings in a matter he is challenging the decision to prosecute him on charges of money laundering when he was offered immunity from prosecution.
This is in order to have the matter resolved excuria.
This is according to a notice of motion for an order to discontinue matter pursuant to order 10 rule 3 of the Constitutional Court rules Statutory Instrument no.37 of 2016 as read with order 21 rule 3 of the Whitebook 1999 edition, filed on February 12, 2024, into court.
On November 30, 2023, the Constitutional Court was informed that the petitioner and the parties who include the Attorney General and the
Ghanaian Minister of Foreign Affairs Shirley Ayoriko said the agreements need to be actualised for the betterment of the two countries.
She believed that with the friendly relations Ghana and Zambia had, it would enable the agreements be implemented.
Ms Ayoriko was speaking yesterday when she paid a courtesy call on President Hakainde Hichilema at State House. “The agreements which we sign should not gather dust but rather implemented. We believe that there is a lot that we can do together because we

In an affidavit in support of the notice to discontinue the matter, Mr Lungu stated that all the parties in the matter were desirous to resolve the matter outside court.
“The applicant desires to explore alternative ways of resolving all issues raised in this matter,”
“That given the happenings in this matter, it is my considered view that this matter be taken out so as to allow parties discuss its resolution away from Court,” he stated.
In his petition filed in 2022, Mr Lungu is seeking a declaration that his arrest and commencement of criminal proceedings against him following his re-arrest is an abuse of criminal proceedings and ultra vires articles 180(7) and 2016 (C) of the Republican constitution. are friendly sister countries,” she said.
And President Hichilema echoed Ms Ayoriko’s statement, that the agreements needed to be brought into fruition. He said there was need to ensure that the two countries made progress on the signed agreements instead of stalling them.
Mr Hichilema said the two countries can only develop if they put what was on paper into reality as it would be critical to the people.
Meanwhile, President Hichilema said African leaders needed to start sitting on high level global decision-making tables. He said Africa must push for the change of financial architecture and can only be done when Africans participate at high level global meetings.
