NOTICE OF INTENTION TO EXECUTE A WARRANT OF DISTRESS AGAINST ONE TENANT NAMELY MR. MATASHA T/A THE OK DELI MART IN CHILENJE LUSAKA

IN THE MATTER OF : SECTION 1 OF THE LAW OF DISTRESS FRO RENT ACT, 1684

AND

IN THE MATTER OF: SECTION 7 OF THE LAW OF DISTRESS AMENDMENT ACT, 1888

AND

IN THE MATTER OF: THE LEASED COMMERCIAL PREMISES KNOWN AS PLOT NO. 96 CHILENJE LUSAKA BETWEEN

LIGHTON SIMBEYE LANDLORD AND

MR. MATASHA T/A THE OK DELI MART TENANT WARRANT OF DISTRESS

TO: B.E Mwale of Plot No. 31752/M Patrick Kangwa Road Lilayi Lusaka- Certified Bailiff of Zambia.

I, the undersigned, LIGHTON SIMBEYE, the landlord of the premises mentioned in this warrant hereby authorize and require you as a bailiff on OUR behalf to distrain such of the goods and chattels as may lawfully be distrained for rent arrears and/Or mesne profits in and upon the said premises mentioned herein now in the tenure and occupation of MR. MATASHA T/A THE OK DELI MART, situate at PLOT No. 96 CHILENJE in the Lusaka province of Zambia for the sum of ZMK66,600.00 being rental arrears from March 2023 to February 2024, due to the landlord’s estates plus costs. NOW THEREFORE, proceed thereon for the recovery of the said rental arrears and/or mesne profits including your Bailiffs fees and evict the tenant and repossess by locking up the subject premises as the law directs and LIGHTON SIMBEYE shall hereby indemnify you against any proceedings that might be instituted against you except for unlawful forceful entry in to the premises that may result in trespass and the tenant shall bear all costs, charges and expenses which you may incur or be liable to pay by reason of your executing of this warrant and the said LIGHTON SIMBEYE also undertake not to hold you accountable for any goods forcibly or clandestinely removed by the tenant or anyone acting on the tenant’s behalf.
