Massbreed contests forfeiture of its $62,000 property
MASSBREED Investments Zambia limited has contested the application by the Anti-Corruption Commission (ACC) to forfeit its truck estimated value of US$62,000, listed among the tainted property belonging to businessman, Francis Muchemwa.
In this matter, the Anti-Corruption Commission applied to the Economic and Financial Crimes Court, to have K13 million worth seized properties belonging to party cadre, Muchemwa, Alias, Commander 2, forfeited to the State.
The alleged tainted properties include his K2.5 million dwelling house known as property no. L/26392/M, No.L/28477/M/H and L/28477/M/J both worth K3.4 million and L/26395/M worth K4.5 million. The said properties are located in Silverest, Chongwe district.
They also want the movable properties that where found at property L/26395/M valued at K461,664 given to the State.
The Commission submitted that the two vehicles, FAW Truck Registration number BAR 9059ZM and BAR 9058ZM valued at US$62,000 each be forfeited to the State.
Muchemwa’s companies namely Altitude Properties limited and Friltech Networks Zambia limited and Massbreeds Investments Zambia limited are cited as first to fourth interested parties respectively.
But Massbreed Investments in an affidavit opposition to the DPP'S application sworn by its General Manger, Abigail Shansonga, said the company owned the Truck with registration number BAR9058ZM.
Ms Shansonga said after the company became aware of the seizure notice issued by ACC, it wrote to the Commission explaining that it was the owner of the seized truck and not Altitude Properties (second interested party) as alleged.
She explained that Massbreed Investments and the Altitude Properties limited had signed a contract of typical hire -purchase agreement on Feb 24,2021, for the hire and subsequent purchase of two FAW 28.290 HP box trucks at a total price of US$124,000.
Ms Shansonga submitted that Altitude Properties breached the agreement of sale as it only managed to pay US$26,656.74 between August 11,2021, and April 5,2022.
