FORMER MINISTER FILES FOR EXCEPTION
FORMER minister Petronella Kagonye who is facing criminal abuse of duty and fraud charges was back in court yesterday where she filed an application for exception.
Kagonye appeared before Harare regional magistrate Ngoni Nduna.
The State is alleging that Kagonye and Glorious Real Estate with intent to defraud Shingiriro Housing Cooperative represented by Joyce Chiroodza misrepresented to the cooperative that he owns Solomia Farm in Goromonzi and offered them land for residential stands and each was to pay US$10 per square metre and they paid US$38 500 causing prejudice to the cooperative.
Using the same modus operandi she reportedly duped US$38 500 from Vaduku Housing Cooperative.
The State also alleges that Kagonye took twenty computers from Potraz after misrepresenting that she was going to hand over the said computers to Goromonzi South Constituency schools but she never gave the computers to any schools in Goromonzi.
In her application for exception, Kagonye claims that there are formal defects apparent on the face of the charge arguing that the State has not shown that Joyce Chiroodza and Ngonidzashe Zvanezuro are registered members of the said co-operatives, the date on which they became members, the value and number of shares currently held by them in their respective co-operatives.
She further argued that the allegations involving co-operatives do not disclose an offence and they are calculated to embarrass her and is pleading to have the charges quashed.
Zivanai Macharaga appeared for the State.
