HUBBY DIVORCES ‘TOXIC’ WIFE

- Mathew Masinge

A HARARE man has divorced his wife of eight years, accusing her of being toxic.

Garikayi Magaya filed for divorce in 2020 and claimed that he failed to resolve issues with his wife, Tabeth Zindere, due to her toxic nature.

The couple married at Masvingo Sports Club on September 8, 2012.

Their marriage produced two children, aged seven and nine, who were born in The Gambia, where Magaya worked for an international humanitarian organisation before moving back to Zimbabwe in 2018.

Magaya claimed that he had failed to resolve issues with his wife due to her toxic nature.

However, Zindere accused Magaya of abuse, claiming that she is being forced to pay US$40 to a counsellor to try and recover from the abuse.

She said she had not lost all her love and affection for Magaya and even tried to get their relatives to intervene for a reconciliation, but he refused to give their marriage a second chance.

Zindere eventually agreed to end the marriage and demanded US$700 as spousal maintenance per month until December 31 this year when she finishes her degree.

She also demanded US$450 per child a month for maintenance, a car, future medical bills, laptops and Wi-Fi for their kids.

During the subsistence of their marriage, the couple acquired an immovable property in Mt Pleasant Heights and another in Masvingo.

But High Court judge, Justice Fatima Maxwell, ruled that the Masvingo property and car, which Zindere was demanding, were not matrimonial property.

“A decree of divorce be and is hereby granted. Magaya is hereby awarded 85 percent share of Stand 2073 Bannockburn, Mount Pleasant Heights, Harare; and Toyota Corolla Altis.

“Zindere be and is hereby awarded 15 percent share of Stand 2073 Bannockburn Mount Pleasant Heights Harare.

“Maintenance of the minor children is to be governed by the order given in the Magistrates Court under M1489/21

“The counter-claim for spousal maintenance post-divorce be and is hereby dismissed,” ruled Justice Maxwell.
