Marriot shuts Kamba out

GLOVES are off ahead of the Dynamos annual meeting as the club’s board of directors have moved to thwart efforts by the Ernest Kamba faction to be part of the important indaba on Sunday.

Lawyer Herbert Mutasa, who is representi­ng Bernard Marriot and his board, yesterday shot down plans for the Kamba group to participat­e at the indaba.

Lawyers representi­ng Kamba had this week requested for minutes of the last seven AGMs, previous audited accounts, registers of the same meetings and copies of adverts of the last meetings.

The lawyers went on to propose a neutral venue as they felt the one proposed for Sunday’s indaba, a private property belonging to DeMbare president Kenny Mubaiwa, was not ideal for such a gathering.

But Mutasa of Gill, Godlonton and Partners yesterday said the demands made by Kamba did not make any impression on him to warrant a response.

“We are talking of an AGM of Dynamos Football Club Private Limited and none of the people mentioned in that letter are members of Dynamos Football Club Private Limited,” said Mutasa.

“If they insist that they are members they must come up with evidence. Membership of a company is conferred by shareholdi­ng and this is a private company we are talking about.

“If anyone thinks he is entitled to come and vote they have to prove their membership by producing evidence of such membership and that is shareholdi­ng certificat­es.

“They can bring the CR14 for directors and the CR6 for shareholdi­ng structure. Dynamos is not a public company and you can only become a member by holding some shares.

“If people want to gather and have tea or coffee, if they can afford, nobody can stop them but what they can’t do is make a decision that will bind Dynamos Football Private Limited unless they are members of it.”

Dynamos board secretary Mthokozisi Nkosi confirmed he had received the letter from lawyers representi­ng the Kamba faction.

“We respect everyone’s contributi­ons to the team. We take exception if you are a former employee and, when you retire from work, you still want to claim ownership of the company,” said Nkosi.

“The majority of people cited have retired and now want to claim ownership.

“People can be incorporat­ed into companies from laid down procedures You don’t bulldoze to be a shareholde­r.

“Late last year they held a number of meetings and they even held their own AGM. What has gone wrong now in their grouping? Why do they want to disturb peace at Dynamos Football Club Private Limited?

“Where were they all these years? If they see anything amiss as former players they know where to go, using the normal channels, and air their views and suggestion­s.

“They must not threaten peace and tranquilli­ty at the club. It’s just unfortunat­e that the majority of them want to ruin their names. They were great players and they must not undo the good they created for a number of years.

“Almost everybody knows that Ronaldo played for Manchester United but Ronaldo can’t go to Manchester United today and claim ownership of the club? No that is not possible.”
