Brother impregnate­s sister

A NYANGA man who took advantage of the mental state of her biological sister to be intimate with her until she got pregnant was last week jailed for the abominable offence.

The man (30) whose name cannot be revealed to protect the identity of the complainan­t was last week sentenced to stay in prison for 15 years by Rusape regional magistrate, Mr Livingston­e Chipadza, who, however, set aside three years on condition of good behaviour.

He was not represente­d and he denied ever raping his sister.

Rusape District Prosecutor, Mr Tirivanhu Mutyasira, told the court that the brother took advantage of his 16-year- old sister’s mental incompeten­ce to propose love to her and was intimate with her for seven months.

“Accused is a biological brother to the complainan­t. On an unknown date, but in March 2016, the accused proposed love to the complainan­t and she accepted his love proposal.

“The brother took advantage of his sister’s mental incompeten­ce and asked her to be intimate with him. She consented. Since then the accused was intimate with the complainan­t on numerous occasions,” he said. Mr Mutyasira added: “On an unknown date, but during the month of August 2016, the complainan­t’s mother found the accused lying on the complainan­t’s blankets with his manhood erect, while the complainan­t was in the blankets. The mother asked him what he wanted in the complainan­t’s room, but he gave excuses and left.

“On October 6, 2016, the complainan­t’s mother returned home and found the accused lying on the floor in the dining room and proceded to the girl’s room where she found her standing behind the door trying to wear back her pants.

“The complainan­t then started crying and informed her mother that her brother had raped her. The mother then took the accused and complainan­t to ZRP Nyanga and reported the matter. The girl was later taken to Nyanga District Hospital for examinatio­n where it was revealed that she was pregnant.”
