Ndlovu is demanding $10 000 for adultery damages and an additional $100 he incurred while towing the BMW.

“Plaintiff’s feelings of piety and dignity have been infringed as a result of defendant’s act. Plaintiff has also suffered loss of consortium that includes not only patrimonial loss, but also immaterial damage associated with the loss of love, friendship and spiritual.

“As a result of the adultery, the plaintiff has suffered damages namely; contumelia inflicted upon in the sum of $5 000, the loss of consortium in the sum of $4 000, pain and suffering in the sum of $900. The defendant knowingly committed the adultery.”

Propeht Mutepfa has seven days, after being served the summons, to either pay the claim or file his response – be it an exception, defence or counter-claim – with the court.

The alleged adulterous affair was revealed at the Mutasa Magistrates’ Court recently during a civil matter in which the prophet made a spoliation application, demanding back his BMW 735i sedan which he allegedly gave Ndlovu in a bid to buy his silence. Although Ndlovu agreed to return the vehicle, he said he would soon file adultery damages against the prophet and claim compensation.

He said he was in possession of overwhelming evidence to support his claim in the form of text messages and pictures which the prophet allegedly exchanged with his wife over the phone using the WhatsApp platform.

Prophet Mutepfa through his lawyer, Mr Lloyd Mvere of Mvere, Chikamhi, Mareanadzo Legal Practitioners, has denied the allegations, saying it was all blackmail.
